CREATIVE ART GLASS INC. warrants its product to be free from defects in material and workmanship on purchase for a period of ONE YEAR FROM THE DATE OF ORIGINAL DELIVERY OR THE DATE INDICATED ON THE DECLARATION OF LAST SUPPLY OF SERVICES AND MATERIAL UNDER A CONTRACT.
The physical property of glass and related materials CANNOT be warranted due to the imperfection of its nature. No other warranty is expressed or implied, and CREATIVE ART GLASS INC. will NOT be liable for any incidental or consequential damages.
The Client is responsible to inspect all products, patterns and hardware prior to installation or within 7 days of receipt whichever occurs first. If the goods are defective, they will be repaired or replaced, at the vendor's option without charge on return to the vendor within 30 days from the date of rejection in writing. Under no circumstances shall CREATIVE ART GLASS INC. be responsible for costs or damages incurred from installation or removal of any defective products. Under no circumstances shall CREATIVE ART GLASS INC. be responsible or liable for any damages caused by its product beyond repair replacement or refund of order as acknowledged.
This warranty is only given to the ORIGINAL PURCHASER of the goods and is VOID if the goods have been
- damaged by negligence or accident after purchase
- used other than for the purpose for which they are intended to be used or not used in accordance with any instructions supplied with the goods
- adapted or repaired other than by the vendor or an approved service agent, or
- added on to or used with other goods which may affect the integrity, performance, safety, or reliability of these goods.
This warranty is given in place of all other warranties and assurances, whether express or implied, including but not limited to matters of quality, fitness for purpose, or merchantability and the vendor accepts no liability, under any circumstances whatsoever, for any consequential damage or loss suffered by anyone as a result of using or being unable to use the goods.
In no event shall Creative Art Glass Inc. be liable, whether in contract of tort, for:
- loss or damage occasioned by delays beyond Creative Art Glass Inc.'s control; or
- loss of earnings, loss of production, loss of use or other consequential damage;
howsoever caused.
When Creative Art Glass Inc. assists the Client with, or performs the design, manufacture, production, supply, delivery, or distribution of any product, the Client agrees to defend, indemnify and hold Creative Art Glass Inc., its employees and agents harmless from and against any claim, suit, action or proceeding initiated by any person or entity, whether a party to any agreement related to the Project or not, in respect of or arising out of the design, manufacture, production, supply, delivery, distribution or use of the product, including any other product-related liability resulting from the work of Creative Art Glass Inc..
